I, Robert Smith Sr. of the County of Morgan and State of Illinois being of sound mind and memory do make orgain and establish the following to be my Last Will and Testament, hereby revoking all other and former wills by me made.
First--It is my will that at my death all my just debts and Funeral expenses - including a suitable monument to be placed at my grave - be fully paid.
Second -- I give devise and bequeath to my beloved wife Mary Ann Smith all of the Estate of which I may die seized, that is to say she is to take all of my Personal property and Real Estate as of her own right and in fee simple.
Third -- It is my will, that in the event my said wife shall die before I do, then in that case my executor hereinafter named shall sell at Private or Public sale as he shall deem best, all of the estate of which I may die seized and marshall the proceeds of any such sales and all money on hand or due and owing to me at the time of my death into a General fund and divide said General fund into six (6) equal parts; And is is my will that one of said equal parts be paid by my executor to my son Robert Smith Jr., one of said equal parts to be paid by my executor to my daughter Eliza Jane Lindsay, one of said equal parts to be paid by my executor to my daughter Mary Lindsay, one of said equal parts to be paid by my executor to my daughter Fannie Smith and one half of one of said equal parts to be paid by my executor to my grandson David R. Smith and one half of one of said equal parts to be paid by my executor to my Grandson George A. Smith the last two named persons being the children of my deceased son David Smith. It is my will that the remaining one sixth (1/6) part of said General fund be invested by my said executor in Real Estate and the rents issues and profits thereof be paid by my said executor monthly to my son George Smith for and during the Period of his natural life: provided however that if my executor shall after consulting with my son George Smith deem it best, then in that case my said executor may at any time thereafter sell at Public or Private sale any or all of said Real Estate and deliver the proceeds thereof to my son George Smith.
Fourth -- It is my will that in case of the death of any of my children or Grandchildren, hereinabove mentioned before I die then the amount hereinabove devised to such deceased person, shall go to and be divided equally between the children of such deceased Devisee and if such deceased person shall die without living issue then the amount above mentioned shall be divided equally between my children then living.
Fifth -- I hereby constitute and appoint my son Robert Smith Jr. to be the executor of this my Last will and Testament. In Witness whereof I have hereunto set my hand and seal this 24th day of August AD 1894.

Jacksonville Journal
October 23, 1894

Robert Smith died Sunday afternoon at his home, 1146 Hardin Ave. Mr. Smith was born in Londonderry, Ireland, 1821 and came to this country in 1834. He settled in Jacksonville with his family in 1860. He made the brick for his home. He had a stroke of paralysis several years ago and died in consequence of a fall. Mr. Smith joined the Reformed Presbyterian Church early in life and at the time of his death was a member of Westminster Presbyterian Church. He had been at church services the Sunday before death came. He leaves behind a wife, 3 daughters and 2 sons.

The funeral occurs at the family residence Wednesday afternoon at 2 o’clock.

Petition for Letters Testamentary

 Petition of Mrs. Mary Ann Smith in the Matter of the last Will and Testament of Robert Smith Sr. Deceased, for Probate of Will and Letters Administration with will annexed to the Hon. Richard Yates Judge of the County Court of Morgan County, in the State of Illinois: The Petition of the undersigned Mary Ann Smith respectfully represents that Robert Smith Sr. late of the County of Morgan aforesaid, departed this life at his residence in Jacksonville in said County, on or about the 21st dady of Octover A.D. 1894, leaving a last Will and Testament, duly signed, published and attested, as believed by your petitioner, and which by her is herewith presented to your Honor for Probate.  That said will is subscribed by James O. Priest and W. S. Baxter as witnesses to the execution thereof. The said Testator in his said last Will nominated and appointed Robert Smith Jr. Executor, whose refusal to qualify is presented herewith with will annexed and your petitioner prays that she be appointed administratrix and is willing and ready to accept and undertake the office and trust if confided to her. And this petition further shows that the said Robert Smith Sr. died seized and possessed of Real and Personal Estate consisting chiefly of four lots, two houses, and household goods, etc and $3000.00 in notes all of said persona estate being estimated to be worth about Three Thousand Three hundred Dollars. That said deceased left surviving him Mary Ann Smith his widow, and Mrs. Eliza Jane Lindsay, Mrs. Mary A. Lindsay and Miss Fannie Smith his daughters and David R. and George A. Smith sons of David Smith a deceased son, as heirs. And your petitioner further prays that it may please your Honor to grant her Letters of Administration with will annexed upon her taking the oath prescribed by the Statute, and entering into bond in such sum and with such securities as may be approved by your Honor.
